Mitchell's lawyers get time to file affadavit

An adjournment was granted Friday until Monday to allow lawyers representing People's National Party candidate Phyllis Mitchell to file affidavits in response to claims being made by Jamaica Labour Party Member of Parliament Gregory Mair.

Mair is contending that he was not properly served with the claim form for the election petition.

Mair's lawyers are seeking to have the petition struck out on the grounds that he was given a copy of the claim form while he was sitting in Parliament.

The application to strike out the petition was set for hearing Friday but was put off to give Mitchell's lawyers sufficient time to file the affidavit.

Senior Puisne Judge Marva McIntosh, who is hearing the matter, told the lawyers that the matter had to be dealt with expeditiously.

Mitchell is contending that Mair has dual citizenship and, under the Constitution, was not entitled to be a Member of Parliament. She is claiming that Mair has Venezuelan citizenship.
