Prisoner sues Government over shooting

A prisoner who is serving a sentence for murder filed a suit in the Supreme Court yesterday against the Government.

The prisoner, 28-year-old Germaine McIntosh, is seeking damages for gunshot injuries he suffered while in prison.

The prisoner is contending that he was shot in the head while in a secured area of the Tower Street Adult Correctional Centre on March 31, 2005.

In the suit filed by attorneys-at-law Christopher Townsend and Heather Sutherland, of the law firm Townsend Whyte and Porter, the prisoner contends that he was shot during a fracas among prisoners.

He is alleging in the suit that some prisoners were armed with guns during the disturbance. He said he was not involved in the disturbance.

The prisoner was taken to the morgue after being pronounced dead but a morgue attendant saw the body 'twitching' and took him to hospital.

McIntosh, who is now at the Horizon Adult Remand Centre, claims he has been both mentally and physically affected as a result of the injuries he suffered to his head. The injury has affected McIntosh's speech.
