The Editor, Sir:In congratulating Mrs. Zaila McCalla on her appointment as Chief Justice, I propose that the most pressing challenges for her urgent attention as the new head of the judiciary are to preserve the independence of the judiciary and to ensure openness in the administration of justice.
These two are vital if there is to be confidence in the system so that an unbiased observer can be satisfied that justice is being done for there to be peace in the land.
Openness requires severe restriction on access to a judge's chambers, especially to discuss any aspect of a trial, and never allowed without the parties to the case and their legal representative present. A hearing in camera is blight on a fair hearing.
'Networking'
Independence requires not only independence from the legislature but also that there be no appearance of 'networking' between the judge and any other departments of government - including legal departments and the police, or with preferred lawyers.
A third challenge that may be included is courtesy from the bench. This Chief Justice is known for her civility which should serve as an example and a salutary influence on others at all levels of the judiciary.
The limited provisions for legal aid available at present place a great burden on judges to ensure that justice is delivered to all in a timely manner.
