IDT rules in favour of Windalco
Published: Wednesday | December 23, 2009
Lawyers for the National Workers Union (NWU) are now going over a ruling of the Industrial Disputes Tribunal (IDT) to uphold the termination of four employees of West Indies Aluminium Company (Windalco).
President emeritus of the NWU, Clive Dobson, told The Gleaner yesterday that lawyers are looking to see if the IDT made any "errors in law" in reaching its decision.
"Subject to that advice, we will determine what's the next step," said Dobson.
The four ex-employees - Trevor Hewitt, Delroy O'Connor, Mark Robinson and Sean Forbes - were among 74 Windalco employees whose positions were made redundant in 2006.
The NWU argued that the company acted unjustly in terminating their jobs since their jobs still existed at the time.
However, after hearing arguments from company executives and the union, the IDT ruled recently that the redundancies were "lawful, fair and justifiable".
