Olint to hear Justice's decision on February 9

JUSTICE ROY Jones is to hand down his decision on February 29 in the application brought by investment club Olint Corporation Limited, which is seeking to bar former Solicitor General Michael Hylton, Q.C. from representing the National Commercial Bank (NCB).

Olint is contending that because Hylton was former chairman of the Financial Services Commission (FSC) he should not represent NCB in its bid to close Olint's account.

The judge heard legal arguments in chambers on Thursday at the Supreme Court and reserved his decision.

In the meantime, the judge has extended the injunction -which bars NCB from closing Olint's accounts - to February 29.

Attorneys-at-law Georgia Gibson Henlin and Maurice Manning who were instructed by Catherine Minto of the law firm Nunes Scholefield DeLeon and Co, argued in chambers that Hylton should be barred from representing NCB because of his former positions of solicitor general and chairman of the FSC.

Lawyer opposing

Attorney-at-law Dave Garcia, a general manager at NCB, opposed the application.

The FSC had issued a cease-and-desist order on Olint in March 2006. Olint took the issue to the Supreme Court which upheld the cease-and-desist order. Olint is appealing against the Supreme Court ruling.

A Court of Appeal judge granted Olint a stay of the cease-and-desist order more than a week ago, but ordered that that no new members be admitted to the club.

Last month, NCB served notices on Olint that it was going to close its account. Olint took the matter to the Supreme Court and got an injunction against NCB.
