A date has finally been set for the hearing of the appeal of former bankers, Melanie Tapper and Winston McKenzie, who have been waiting for four years for the notes of evidence in their fraud case.The notes of evidence were received at the Court of Appeal Registry last month, and November 12 has been set for the hearing of their appeal.
Appealing 2003 convictions
They are appealing their convictions in April 2003 and their 18-month prison sentences for defrauding Kingston businessman Bentley Rose and his company Benros Ltd., of a total of $7 million.
Mrs. Tapper, former general manager of Trafalgar Commercial Bank, was convicted in April 2003 of one count of defrauding Rose of $2 million.
McKenzie was employed to Workers Bank (now RBTT) at the time of the loan transactions with Rose.
The Crown led evidence at the trial, which lasted over a three-year-period, that Rose was defrauded during banking transactions. Evidence was given that loans far in excess of what Rose had authorised were made and his properties used as collateral.
They are on bail in the sum of $8 million each with sureties.
