The United Kingdom Privy Council is to make a final determination in the legal battle between Portmore residents and the Government over the Portmore Toll Road.

Some Jamaica Labour Party (JLP) councillors are among the group challenging the Toll Road Act.

The Court of Appeal granted final leave to appeal yesterday after hearing an application from Attorney-at-law Oswald James, who is representing the appellants.The United Kingdom Privy Council is expectedto hear the appeal this year.

The residents, including JLP Councillors Andrew Wheatley, Keith Blake andformer JLP Councillor Natalie Camp-bell Rodriques, are seeking several declarations.

They are also contending that the designation of the Mandela Highway as a route is unlawful.

They are asking the Privy Council to rule that under the Toll Road Act, there must be a route in the area in which the toll road is established.

It is their contention that th route is in a quite different area, and is more than twice as long in distance.
