Defence lawyer Hugh Thompson yesterday made an application in the Corporate Area Resident Magistrate's Court seeking the immediate release of a man who was detained in connection with the multimillion lottery scam in Montego Bay.
Jomo Bernard, singer and musician, of Bogue Hill Village, Montego Bay, is contending in his affidavit seeking a writ of habeas corpus (order for immediate release) that he was detained on February 8 and since then, has not been charged or taken before the court.
Resident Magistrate Judith Pusey, after hearing submissions from Mr. Thompson, sent instructions to Assistant Commissioner of Police (ACP) Les Green for him to attend court to explain why Bernard had been in custody for such a long time without being charged.
A superintendent of police later informed the court that a team of police headed by ACP Green would be conducting a question-and-answer interview with Bernard today.
RM Pusey told Mr. Thompson to return court on Thursday so that a determination could be made in the matter.
