Lawsuit against Adams dismissed

MR. JUSTICE Donald McIntosh ruled yesterday that a businessman who had brought a suit against Reneto Adams, Senior Superintendent of Police, and the Attorney-General seeking damages for assault and trespass, had failed to prove his case.

The judge ordered the claimant, Michael Emannuel, of Spanish Town, St. Catherine to pay the defendants' costs in the sum of $88,000.

Emmanuel had claimed that he was assaulted by Senior Supt. Adams and another police officer when they visited his businessplace in Spanish Town two years ago. Emmanuel had sued seeking damages for assault and battery, contending that the policemen trespassed on his property and assaulted him. He claimed that during the assault his shirt was torn. He had also sued for damages for malicious destruction of property.

Senior Supt. Adams denied the claim and in giving evidence in the Supreme Court said he went to the premises to execute a search warrant. He said he conducted an operation at the premises in Spanish Town after receiving numerous complaints of alleged illegal activities taking place on the premises. He said during the execution of the warrant, Emmanuel who was being barred from leaving the premises, struggled and escaped.

Attorneys-at-law Annaliesa Lindsay and Garfield Haisley from the Attorney-General's department represented the defendants and asked the judge to dismiss the suit as Emmanuel had failed to prove his case.

The judge agreed and dismissed the suit.

Emmanuel was represented by attorney-at-law Arlene Harrison-Henry.
