THE SUPREME Court has struck out a lawsuit brought against chairman of Superclubs Resorts John Issa by head of Sandals Resorts Gordon 'Butch' Stewart, who claimed that Issa published defamatory material about him last year.
Issa had received an email from a 'Dr Paulette Robinson' with derogatory material about Stewart and a politician.
He sent the contents to his attorney-at-law who also repre-sented the politician named in the email.
Libellous email
The politician was shown the email and allegedly, he revealed the contents to Mr Stewart, who took out a lawsuit against Mr Issa for publishing the libellous email.
In court, the judge struck out the case, arguing that there was no publication of the slanderous material because it was revealed only to Issa's attorney, who is covered by legal privilege.
It was also argued that if the material were published to one person, the damages would be insignificant for the court to allow the claim to continue.
Legal costs were awarded to Issa.
