Customer sues RBTT

A MONTEGO BAY businesswoman has sued RBTT seeking to recover $4 million that allegedly went missing from a lodgement to her account in September 2003.

Cynthia Medley-Rowe, wholesaler of cellular telephone cards and a customer at the RBTT branch at the LOJ Shopping Centre, Montego Bay, claimed that on September 29, 2003, the lodgement was made in a lodgement book provided by the bank. When she received the lodgement book on September 30, 2003, she inspected it and found that the lodgement was made and was received by the bank. There was no page missing from the book at that time.

Ms. Medley-Rowe said that on October 3, 2003, she was informed by an employee of the bank that her account was in overdraft. She said she informed the employee that she did not have an overdraft facility at the bank.

A lodgement was made on October 3, 2003 but the lodgement book was not returned the following day as was customary. The book was not returned until six weeks later and she claimed that she made repeated requests for its return but her requests were met with numerous excuses and she was even told that the bank did not have the lodgement book.

The matter was reported to the manager for the bank but despite repeated requests, the bank failed to credit her account.

The claimant is seeking to recover damages for fraud and negligence and the immediate return of the $4 million with interest.
