FTC and utility companies

THE EDITOR, Sir:

I WRITE this letter with a view to expelling from the minds of the public any doubt which might now exist, regarding the jurisdiction of the Fair Trading Commission (FTC) over the utility companies which operate in Jamaica at this time.

Arising out of a discussion between myself and Mr. Wilmot Perkins, the Host of 'Perkins On Line' on Hot 102 FM on Thursday, May 24, 2001, I indicated to him that the Jamaica Public Service Company Limited (JPSCo) was by Order dated March 12, 2001, exempted from the jurisdiction of the FTC. I confirm this information to be accurate.

One day later, in a discussion with Mr. Winston Hay, director-general of the Office of Utilities Regulation (OUR) and Mr. Delroy Chuck, on the said programme 'Perkins On Line', Mr. Wilmot Perkins asserted that I had advised him the day before, that the FTC has no jurisdiction over Cable & Wireless Jamaica Limited (C&W). I gave Mr. Perkins no such information.

In the interest of clarity, I advise the public that save for the JPSCo., the utility companies are susceptible to the jurisdiction of the FTC. Complaints which do not contain competition issues are re-routed to the OUR or the Consumer Affairs Commission.
